We are Simple Family Travel and are excited to help you with your travel. The following terms & conditions (the “Agreement”) describe what you can expect from us. The terms “we”, “us”, and “our” refer to AGENCY_NAME (herein referred to as SFT), and the term “you” refers to the individual who signs this agreement.

Before we can finalize arrangements for your trip, we require that you acknowledge your agreement with the following terms. Your signature represents your acceptance. These conditions apply to yourself, your family or traveling companions that you represent or make payments on their behalf.

Booking Terms and Deposit: We offer retail travel services to our customers, which are provided by separate and independent vendors. We do not operate, control, or otherwise provide the services of these independent vendors. While we carefully select top quality suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may arise from these services.

In order to research, plan and arrange your customized vacation itinerary, we require a non-refundable Planning Fee once you’ve approved our proposal. The amount varies based on your trip, but generally is $400-$600 per trip. Utilizing our years of experience, professional expertise and connections with top worldwide suppliers, we will personally research and put together a custom trip to meet your specific needs. This planning fee will be due after our initial trip planning consultation. We will provide you with a high- level itinerary and pricing; once you have approved this initial proposal, we will begin booking all the components of your trip. We will provide detailed invoicing, and full / final payment will be due to us by 60 days prior to your departure. SFT accepts electronic payments via a secure and encrypted payment portal, by credit card or bank draft (please note there may be a “convenience fee” added). Booking Accuracy / Legal Names: You are required to immediately review all aspects of your booking to verify (but not limited to): passenger names, mailing address, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking confirmation. Please notify SFT immediately if any omissions and/or corrections are needed. You assume full and sole responsibility for any and all risks and /or costs involved with failure to report such errors and/or omissions. The name, date of birth and gender that appears on your passport or government issued ID must exactly match the same such data that is listed on airline ticket(s) and booking records. You are responsible for obtaining and payment for passports, visas, and any other necessary travel documents for your destination. SFT strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within 6 months of the return date of travel.

Changes, Cancellations and Refunds: Changes are subject to availability and cannot be guaranteed. Generally, changes to itinerary components can be made up until 60 days prior to departure. However, this varies greatly by supplier (i.e Airlines typically do not allow changes once booked)

All cancellation requests must be made in writing to be eligible for any refund of monies paid. Cancellation policies vary by supplier, and will be advised at time of quote, booking, or final payment. The initial Planning Fee is non-refundable; any remaining refunds will be determined and reimbursed within 30 days of cancellation.
Travel Insurance: Travel insurance protection is strongly recommended. As your travel advisor, we have a professional responsibility to recommend the purchase of travel insurance to cover certain risks inherent in travel. Travel protection plans help protect your investment against the unexpected, and can include coverage for Trip Cancellation, Trip Interruption, Emergency Medical/Evacuation, Trip Delay, Baggage, and more. Travel Insurance information will be sent to you at time of booking; we urge you to thoroughly read the policy’s confirmation of benefits. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim. Please note that the travel insurance provider may not be allowed to discuss your claim with SFT due to privacy laws (e.g.HIPAA). You acknowledge and agree that SFT has no control over the travel insurance provider or its coverage decisions, and as a result SFT is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.

Liability & Force Majeure: You understand that SFT acts in good faith, acting solely as an intermediary for vendors and service providers, and as such is not liable for breach of contract or any intentional or careless actions or omissions on part of suppliers which may result in any loss, damage, delay, injury, death, sickness, or accident sustained by you or your travel companions. By embarking on this travel, you voluntarily assume all risks involved with such travel, whether expected or unexpected.

You acknowledge and understand that cruise lines, tour operators and other suppliers may have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Pricing and availability may change without notice. You acknowledge that SFT is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies, or incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold SFT harmless for any actions or damages arising from Supplier pricing.

SFT has no special knowledge regarding the financial condition of the suppliers, unsafe conditions, health hazards, weather hazards, climate extremes, or the suitability for disabled persons of any portion of any tour at locations to which you may travel. For information concerning possible dangers at destinations, we recommend you review the Travel Warnings section of the U.S. State Department www.travel.state.gov. or contact them at 202-647-5225. For medical information, we recommend you contact the Centers for Disease Control at 800-CDC-INFO or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all conditions regarding health, safety, security, political stability, and labor or civil unrest at destinations you will be traveling to. You hereby release SFT from all claims arising out of any problem covered in this paragraph, and to submit all other claims against us within 30 days after the return of your trip. You agree that all suits in connection with or incident to, this agreement shall be litigated, if at all, in the courts in Essex County, Massachusetts which will serve as the exclusive jurisdiction for all claims brought by you or SFT, and you hereby submit to the personal jurisdiction of those courts.

“Force Majeure” means in relation to SFT, any circumstances beyond the reasonable control of SFT, (including but without limitation, acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). SFT shall not be liable for any loss or damage incurred by you, as a consequence of any of the Suppliers being unable to perform its obligations due to the unusual or unforeseeable circumstances (a “force majeure event”) beyond the control of the party affected by the force majeure event.

Power of Attorney: As our client, you hereby appoint SFT to be your attorneys-in-fact for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, insurance and hotel guarantees. You authorize any of the attorneys-in-fact to authorize credit card authorizations for said purchases whenever any of them receives an online, phone, or email booking request reasonably believed to be from you or someone acting on your behalf, requesting travel arrangements be charged to this credit card account. You agree that you will pay for all such purchases and will not hold us responsible for any of our actions pursuant to this power of attorney.
